Established by the Mental Health (Scotland) Act 1960, after the dissolution of the General Board of Control for Scotland.
The Mental Health (Scotland) Act 1984 continued the Commission but with certain changes in its constitution and with additional powers, functions and duties given to it. The Adults With Incapacity (Scotland) Act 2000 increased the Commission's responsibilities further. Commissioners are appointed by HM The Queen.
